Austin Legal UK Rss_logo

Welcome to Morton Fraser's Business Law blog.

austin flynnI'm Austin Flynn and I am a corporate lawyer and the head of Morton Fraser's Business Team where we advise business owners from our offices in Edinburgh, Glasgow and London

This blog is going to include my ‘thinking out loud’ on a variety of legal subjects, but in particular the ramblings (and no doubt occasional rantings) of a lawyer who is privileged to become involved with a wide variety of businesses making their way in the 21st century.

Every now and then I will also invite a guest blogger to contribute to the conversation.

Schoolboy error. Mea culpa.

Back in the heady days of October 2011, when I was a new blogger, tweeter, podcaster and general 'social media novice' I rashly promised our Marketing Manager that I would easily produce a weekly blog on commercial legal matters.

What a load of old ROT

When I was a young lawyer plying my trade in Newcastle I seemed to spend half my time dealing with 'retention of title' (ROT) clauses in contracts.

The Corporate Veil: Tough As Old Boots

I've always though that the phrase 'corporate veil' is a bit archaic. It reminds me of the scene in the Wizard of Oz where the Wizard is revealed as an old bloke controlling a sound and light show from behind a curtain...

Personal guarantees - they don't just disappear of their own accord

They're a necessary evil and they aren't going to go away.

DNA, but what about the DPA?

After my tenuous and convoluted attempt in last week's blog to include a reference to horse-burgers, I do actually have a serious point to make about the fact that the offending burgers contained ingredients that shouldn't have been there.

Solving the energy crisis (and horse-burgers)

I had a brainwave last night when I arrived at home to find that for some reason the Council hadn't collected the paper recycling bag that we'd left outside the front gate yesterday morning.

Let's jump aboard the 2013 train and ride it all the way to Successville

In spite of the general love of Christmas in the household, however, I always find that by 6th January I'm more than ready for the tree and other decorations to come down and for life to return to normal (or what almost passes for normal).

Lord McAlpine - the tweet to end all tweets in 2013?

If you'd said to me even three months ago that I'd be writing a blog vehemently defending the threat from a Tory party grandee to raise multiple legal actions for defamation I'd have said you had a screw loose; but here I am, doing just that.

The Communications Data Bill. 1984?

This week's blog is about the loss of our little remaining privacy and a couple of trivial and completely unrelated and vaguely seasonal anecdotes.
