Our clients in this example have a large team of in-house Health & Safety advisers. Following an accident at work the possibility of a prosecution arose. Preparing was likely to have been time consuming although they wished to protect their position during investigations.
Our solution was to work with managers and staff on site in advising on the process to be followed by the prosecution authorities and in preparing for their interview. We discussed the issue with senior managers with a remit for health and safety in advance but this avoided the need for them to travel to the site allowing them to focus on other matters.
