Further parts of the Wildlife and Natural Environment (Scotland) Act 2011 are coming into force
A second Commencement Order relating to last year’s Wildlife and Natural Environment (Scotland) Act 2011 (“WANE”) has taken effect from 1 January 2012.
The new Commencement Order brings into force parts of the Act relating to vicarious liability, the close season for hares, the management of deer and snaring law.
This may affect land management for landowners, factors and trusts. Key elements include the implications for the employer or landowner if the employee or agent falls foul of the right to kill or take wild bird on the land. The requirement that all snares must be fitted with an ID tag and number is not expected to come into force until 2013, to allow time for those who operate snares to complete a compulsory training course, which will be required before an ID number can be issued.
