Private Landlord Registration Update

Many of the first landlord registrations under the Antisocial Behaviour etc (Scotland) Act 2004 are now up for renewal with local authorities.  Under the legislation almost all private landlords must apply for registration with their local authority.  The local authority must be satisfied that they are fit and proper persons to let property, before registering them.  An important exemption to note is that there is no requirement to register in repsect of crofts or agricultural land subject to an agricultural tenancy where the agricultural tenant lives on the property. 

For those who do need to renew their registration this can be done at any time within the 3 months prior to the expiry date of the original registration.  The renewal fee is £55 with an additional fee of £11 for any property let.  Online applications attract a 10% discount.  Registrations are valid for 3 years from the point of approval by a local authority.  Failure to renew your application (or failure to have one in the first place) may result in enforcement action being taken as it is a criminal offence for a landlord to let property without being registered or having submitted a valid application for registration or renewal.
