The rural landscape offers an array of economic opportunities such as hunting, shooting, fishing, and walking, to name but a few.
The right to roam reforms implemented by the Land Reform (Scotland) Act 2003 permit access to large landed estates subject to responsible behaviour. Nonetheless, reported cases such as Snowie v Stirling Council and Gloag v Perth and Kinross Council have decided that areas of privately owned land can be excluded from general access rights where necessary, for the purposes of ensuring the privacy and amenity of the proprietors.
At Morton Fraser we can offer advice on these rights and can assist in the drawing up of access agreements, fishing and shooting leases, or other rights which need to be regulated.
