We are frequently instructed to advise clients on the legal aspects of their complex development proposals.
We see real benefit in being involved from the outset, as a member of the Project Team. We can help to avoid the scope for legal challenge of the planning permission which is subsequently granted by ensuring that the relevant legislation and the proper procedures are followed from the outset. Failure to comply with the regulations can introduce scope for judicial review of any planning permission.
Planning law has recently undergone major changes, with a raft of new regulations having been brought into force in August 2009. We can guide you through the legislative maze.
We have particular expertise in Environmental Impact Assessment applications – that is those proposals which are likely to have a significant effect on the environment, and to which the Environmental Impact Assessment (Scotland) Regulations apply.
We have recently supported Dounreay Site Restoration Limited in their planning application for a low level radioactive waste repository at the Dounreay site. Through working closely with the Project Team, we were able to guide DSRL through the planning process, and help to secure the grant of planning permission.
