We are finding that the use of planning agreements – for example agreements under section 75 of the Town and Country Planning (Scotland) Act 1997 – are becoming more common and more complicated. A section 75 agreement is used to restrict or regulate the development or use of land and becomes part of the title to the land. Such an agreement is used when a straightforward planning condition would be inappropriate or unsatisfactory.
