In 2013 the then coalition Government indicated that they intended to consult on the issue in 2014. However, before any consultation could take place the case of Tirkey v Chandok indicated that caste came under the general concept of "race" and was already protected under the Equality Act 2010.
However, a consultation has now been launched seeking views on how best to ensure that there is appropriate legal protection against caste discrimination. The Government is seeking views from those who may suffer caste discrimination as well as the wider community, businesses, service providers, educational and other institutions and public authorities. The consultation will run until 18 July.
