I am delighted to have been asked to speak at the Proceeds of Crime Conference which is being organised by the Faculty of Advocates and the Proceeds of Crime Lawyers Association for Friday 20 February 2015. Speakers are to include Lord Toulson, the Solicitor General, the Dean and a number of experienced practitioners. It is good to see such a high profile conference organised to discuss the use of proceeds of crime legislation in Scotland.
The Crown has, in recent years, turned its attention to the appointment of Enforcement Administrators when confiscation orders have gone unpaid. The Court can be asked to appoint an Administrator who is given wide powers, under the supervision of the Court, to take possession of a convicted person's 'realisable property' and sell that property in order to satisfy the confiscation order. Morton Fraser has acted for Administrators in a number of these cases.
