An award for injury to feelings is made to compensate for injury to feelings caused by discrimination. The award is separate from an award to compensate for financial loss and can be made even where no financial loss has been suffered.
To assist Employment Tribunals, the Court of Appeal previously set out guidance for quantifying awards for injury to feelings, known as the Vento bands and these "Vento bands" have just been updated.
The bands are split into three categories - less serious cases such as one off incidents, more serious cases not so serious as to justify the top banding, and the very serious cases where there may have been an extended campaign of harassment over several years. This is the first annual update to take effect since the bands were reviewed and amended by the Presidents of the Employment Tribunals in September last year.
The new bands which will apply in all cases presented on or after 6 April 2018 are as follows:-
|Lower band (less serious cases):||£900 to £8,600|
|Middle band:||£8,600 to £25,700|
|Upper band (most serious cases):||£25,700 to £42,900|
Awards over £42,900 will only be made in very exceptional cases. The bands will be reviewed again in March 2019.
