He is experienced in dealing with catastrophic injury cases, medical negligence actions and employment and motor accident cases. He has extensive experience in health and safety enforcement notices and prosecutions and Fatal Accident Inquiries. He has acted for the Health and Safety Executive in major inquiries and recently acted for the claimants in Hamilton v Ferguson Transport which resulted in the largest bereavement awards in Scottish legal history for a husband and his daughter.
Jim has also acted in a number of cases which have resulted in developments in the law (e.g. Delaney v McGregor Construction where Jim's client was awarded a new category of damages for future earnings losses).
Jim has been very good at steering me through this process. He has been proactive in getting everything ready and has kept up the pressure on the other party to clearly state their grounds for appeal. He has been challenging them to produce documents and reasoning behind their statements. He has also been readily available to discuss any matters relating to the hearing.
Recommended for his ‘efficient, no-nonsense approach to progressing litigation’.
I was injured in a car crash pile up and was delighted by the compensation Jim Herd won for me. They told me at the start what they would do and how much I would get and they delivered it to my brother and I. Great service, no messing about.
Mr Herd stood up for our families' rights and helped us after my brother was killed at work...They helped my family raise a claim against my brother's employers and the owners of a dangerous work site.... I feel justice was done and that we were vindicated.
I lost my arm in a terrible work accident when it was caught a picker line conveyor belt in a recycling plant...Jim agreed to help me and my family and arranged to meet me with a polish speaker where everything was explained...I was a little worried about getting involved in a court case in what for us was a new country but Morton Fraser were very helpful to me throughout and took care of everything.
Life changing road traffic accident injuries
Jim represented me in a road traffic accident where a lorry forced me off the road and I smashed into a tree. I suffered very serious injuries. Despite the driver's solicitors rejecting any fault we proved that the driver was wholly to blame and after various offers made by them were each rejected, on my lawyer's advice we finally accepted a 6 figure sum which was 4 times larger than their original offer. Jim fought the case every inch until they finally conceded everything. I really couldn't have got through it all without your continued support and hard work so thank you again.
