At Morton Fraser Lawyers we have highlighted clarity as our guiding principle.
This directs the way we communicate, the way we advise, the way we conduct relationships with our clients and the way we are totally transparent and upfront about our charges. This applies to all our services from the straightforward to the more complex.
As an employer, if you want to hire someone from outside the EU, it is necessary to consider their visa status.
That isn’t always easy as there are a large number of visa categories and each has their own visa conditions. This can make it difficult for an employer to be confident they are taking the right steps when offering employment to a non EU national.
The penalties for making a mistake when hiring a non EU national can be severe. If a business hires an employee who doesn’t have the right to work they can face:
Fines of up to £20,000;
Possible criminal penalties;
Loss of their right to sponsor work visas; and
Temporary closure notices to allow the Home Office to investigate the Right to Work of other staff.
Sometimes the staff you will want to hire, retain or transfer will not be British nationals or hold the automatic right to work in the UK. In these circumstances you may need to be registered with the Home Office and we can assist with this.
We can assist with the obtaining and operation of a sponsor licence. Once you are registered with the Home Office we can help you ensure that you satisfy the requirements in relation to advertising and are paying the correct salary to allow you to obtain a Certificate of Sponsorship for the employee. Finally, we can help the employee with their immigration application to ensure that their visa is obtained and your business is not disrupted by a refusal.
Benefits we bring
We can provide support to your hiring managers by:
Answering queries about whether an overseas individual has the Right to Work in the UK, and any restrictions you need be aware of;
Providing training on carrying out Right to Work checks to ensure you do not hire someone who is not allowed to work in the UK; and
Carrying out Right to Work audits to make sure your processes are working as they are supposed to.
If you have any questions or concerns about Right to Work issues, it is important to get advice as soon as possible. Early intervention can help avoid issues and penalties so please get in touch.
Our approach to fees
Where possible we offer fixed fee packages for advising on employing overseas staff. We break our fees down according to the stages of the process so our fee for each aspect of the work is clear. If it is not possible to offer a fixed fee then we will provide a clear indication of the likely fee based on agreed scope of work.
