If you are involved in any type of dispute, from a business dispute to a workplace problem, the most effective way to resolve it is by reaching agreement between those involved. That is often difficult without skilled assistance. Rather than going to Court, using a mediator to help reach agreement gives you a better chance of reaching a mutually acceptable solution.

Why use mediation:

  • Focus on what is important to you
  • Parties are in control of the outcome
  • A resolution can be agreed quickly
  • More flexible than going to Court
  • Cost effective
  • Allows you to explore a range of options
  • Discussions are confidential
  • Parties can be represented

What happens in the mediation process?

A mediator will help parties arrive at a negotiated outcome but assisting in communication between the parties to the dispute. That is done in a confidential setting. Whilst no two mediations are the same in terms of how they are structured the steps in the mediation process typically involve a number of private and joint meetings. At the end of the mediation, if agreement is reached this is usually set out in a written form. Parties can be represented by lawyers at mediation and can agree that others such as relatives may be present

How we can help you

David Hossack is one of the leading mediators in Scotland with a wealth of experience in dispute resolution. He is an accredited specialist in Commercial Mediation which makes him extremely well placed to assist with the resolution of business disputes.

We can offer mediations online or in person in a format tailored to suit the needs of the participants.

Our approach to fees means that you are clear as to the costs involved. We charge £950 plus VAT for a mediation of up to 3 hours duration with one of our mediators. Our fee includes the preparation time for that mediation, as well as preparatory meetings with parties. Unless otherwise agreed, the fee will be shared between the parties and payable in advance of the mediation. If a longer mediation is required, we will discuss and agree a fee with you. Where the mediation is to take place in person, there may be costs for meeting facilities where we are unable to provide these in our offices.
