Agricultural and Rural Property Litigation

The resolution of disputes relating to agricultural tenancies and crofting matters requires specialist advice. Our team is knowledgeable and experienced in both of these fields, in addition to our general expertise in property litigation matters. We regularly act on behalf of clients before the Scottish Land Court, the Lands Tribunal for Scotland as well as conducting litigation in Sheriff Courts throughout the country and in the Court of Session.

How we can help you

Whilst litigation should always be a last resort in any situation, should that be necessary, our team can confidently deal with issues including:

  • Agricultural tenancy disputes in terms of the Agricultural Holdings (Scotland) Act 2003, including those relating to the termination of such tenancies and diversification issues
  • Crofting matters including in relation to the resumption of croft land and disputed entries in the Crofting Register
  • Compensation claims following upon the compulsory purchase of agricultural or rural property
  • Servitude disputes, including those relating to access
  • Applications for discharge or variation of title condition
  • Contractual disputes, including in relation to property sales, purchases and leases

Our team is also trained and experienced in mediation and other forms of alternative dispute resolution.
